Privacy Policy

Effective February 2019

Great Lakes IPM (“GLIPM”) provides this Privacy Policy to inform you of our policies and procedures regarding the collection, use and disclosure of personal information we receive from users of (this “Site”). This Privacy Policy applies only to information that you provide to us through the Site. This Privacy Policy may be updated from time to time. We will notify you of any material changes by posting the new Privacy Policy on the Site. You are advised to consult this policy regularly for any changes. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use.

As used in this policy, the terms “using” and “processing” information include using cookies on a computer, subjecting the information to statistical or other analysis and using or handling information in any way, including, but not limited to collecting, storing, evaluating, modifying, deleting, using, combining, disclosing and transferring information within our organization or among our affiliates within the United States or internationally.

Information Collection and Use

Our primary goals in collecting information are to provide and improve our Site, Services and Site Content, and to enable users to enjoy and easily navigate the Site.

Personal Identifiable Information

This refers to information about you that can be used to contact or identify you (“Personal Information”). Personal Information may include, but is not limited to, your name, website and email address. We use your Personal Information mainly to provide the Services and administer your inquiries. We will create your Account for your use of the Site and Services based upon the Personal Information you provide, and you will become a customer of GLIPM.

  • We use your Personal Information (in some cases, in conjunction with your Non-Identifying Information) mainly to provide the Services, complete your transactions, and administer your inquiries.
  • Certain Non-Identifying Information would be considered a part of your Personal Information if it were combined with other identifiers (for example, combining your zip code with your street address) in a way that enables you to be identified. But the same pieces of information are considered Non-Identifying Information when they are taken alone or combined only with other non-identifying information (for example, your viewing preferences). We may combine your Personal Information with Non-Identifying Information and aggregate it with information collected from other Users (defined below) to attempt to provide you with a better experience, to improve the quality and value of the Services and to analyze and understand how our Site and Services are used. We may also use the combined information without aggregating it to serve you specifically, for instance to deliver a product to you according to your preferences or restrictions.
  • Log Data. When you visit the Site, (our servers automatically record information that your browser sends whenever you visit a website (“Log Data”). This Log Data may include information such as the browser type or the webpage you were visiting before you came to our Site, pages of our Site that you visit, the time spent on those pages, information you search for on our Site, access times and dates, and other statistics. We use this information to monitor and analyze use of the Site and Services and for the Site’s technical administration, to increase our Site’s functionality and user-friendliness, and to better tailor our Site to our visitors’ needs. We also use this information to verify that visitors to the Site meet the criteria required to process their requests. We do not treat Log Data as Personal Information or use it in association with other Personal Information, though we may aggregate, analyze and evaluate such information for the same purposes as stated above regarding other Non-Identifying Information.

Usernames, Passwords and Security

You and your company are entirely responsible for all activities that occur on this site using your username and password, whether the activities or the use of your password was authorized by you or your company. You or your company must notify GLIPM immediately of any known or suspected unauthorized use of your username and password or any other breach of security.

Updating User Information

You and your company agree that GLIPM may provide notices related to these terms and conditions or to this Site by e-mail using the latest e-mail address you or your company has supplied to GLIPM.

If you cease to be an employee or authorized agent of your company or cease to be authorized by your company to use this Site, then your company must promptly notify GLIPM, and you are no longer authorized to use this Site.

As between you and your company and GLIPM, GLIPM shall have sole and exclusive ownership of all right, title, and interest in and to this Site, including, without limitation, the design, features, functionality, navigation, content, and "look and feel" of this Site, and all data collected through this Site, including, without limitation, all intellectual property rights associated therewith, such as all copyrights, patents, trademarks, trade secrets, and know-how.

Right to Change Site

GLIPM reserves the right to alter the content and functionality of this Site in any way, or to limit access to this Site, or to shut down this Site temporarily or permanently, at any time, for any reason, without prior notice, and will not be liable in any way to you or your company for possible consequences of such changes or shut down.

These are covered in the “Google Analytics” section below. Any other stored information is used to monitor and improve site performance and provide an improved user experience.

Google's advertising requirements can be summed up by Google's Advertising Principles. Users may opt-out of the use of the DART cookie by visiting the Google Ad and Content Network privacy policy.

We, along with third-party vendors such as Google use first-party cookies (such as the Google Analytics cookies) and third-party cookies (such as the DoubleClick cookie) or other third-party identifiers together to compile data regarding user interactions with ad impressions and other ad service functions as they relate to our website.

Opting out: Users can set preferences for how Google advertises to you using the Google Ad Settings page. Alternatively, you can opt out by visiting the Network Advertising Initiative opt Out page or by using the Google Analytics opt Out Browser add on.

Identity theft and the practice currently known as “phishing” are of great concern to GLIPM. Safeguarding information to help protect you from identity theft is a top priority. We do not and will not, at any time, request your credit card information, login information, or national identification numbers in a non-secure or unsolicited e-mail or telephone communication. For more information about phishing, visit the Federal Trade Commission’s website.

Business Transfers. GLIPM may sell, transfer or otherwise share some or all its assets, including your Personal Information, in connection with a merger, acquisition, reorganization or sale of assets or in the event of bankruptcy.

We will make any legally required disclosures of any breach of the security, confidentiality, or integrity of your unencrypted electronically stored “personal data” (as defined in applicable state statutes on security breach notification) to you via email or conspicuous posting on the Site in the most expedient time possible and without unreasonable delay, insofar as consistent with (i) the legitimate needs of law enforcement or (ii) any measures necessary to determine the scope of the breach and restore the reasonable integrity of the data system.

Your and your company's use of this Site, it's Content, including product labels, and any products, programs or services made available through this Site is at your and your company's sole risk. Terms and Conditions of Sale

These Terms and Conditions of Sale ("Terms") are attached to and made part of the written order confirmation ("Order Confirmation") sent by Great Lakes ("GLIPM") to the Buyer ("Buyer") acknowledging GLIPM's acceptance of Buyer's order of GLIPM products (the "Products"). These Terms are also attached to and made part of GLIPM's invoice for the Products. By submitting an order for the Products, whether by telephone, electronic mail, on GLIPM's website or other means of communication, Buyer agrees to accept these Terms as the terms and conditions governing the sale of the Products by GLIPM to the Buyer (the "Sale"). GLIPM and the Buyer are sometimes referred to herein individually as a "Party" and collectively as the "Parties."

  1. Changes: No change to any of these Terms shall be binding on GLIPM unless GLIPM's authorized officer expressly consents to the change in writing. In the event of any conflict between these Terms and the provisions set forth in any Buyer document or communication, including Buyer's pre-printed purchase order or any other form, document, or written or oral communication supplied by Buyer to GLIPM, whether before, on or after the date of Buyer's order, these Terms shall prevail. GLIPM's failure to object to any provision set forth in any document or communication supplied by Buyer shall not be construed as a waiver of these Terms nor as acceptance of any such provision.
  2. Purchase and Sale of Products: GLIPM agrees to sell, and Buyer agrees to purchase the Products for the purchase price set forth in the Order Confirmation. If you choose a direct payment gateway to complete your purchase, then the payment gateway stores your credit card data. Your credit card data is not stored by GLIPM or on this website. It is encrypted through the Payment Card Industry Data Security Standard (PCI-DSS). Your purchase transaction data is stored on the gateway side only as long as is necessary to complete your purchase transaction. After that is complete, your purchase transaction information is deleted. All direct payment gateways adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by GLIPM and its service providers.
  3. Delivery Terms: Incoterms as in effect on the date of the Order Confirmation shall apply to all GLIPM sales. Unless otherwise specified by Buyer and agreed to in writing by GLIPM, the following Incoterms ® are selected: (a) sales will be made Ex Works from GLIPM's facility or other loading point; (b) delivery of the Products to Buyer's carrier at the loading point shall constitute delivery to Buyer; and (c) all risk of loss or damage in transit shall be borne by Buyer. GLIPM reserves the right to make delivery in installments, all such installments to be separately invoiced and paid when due per invoice, even if additional installments are required to complete Buyer's order.
  4. Claims: Immediately upon delivery of Products to Buyer, Buyer shall inspect the same and shall give notice to GLIPM of any claims for shortages, defects or damages; and Buyer shall hold any damaged or defective Products for GLIPM's written instructions concerning disposition. If Buyer fails to so notify GLIPM within fourteen (14) days after the Products have been delivered to Buyer, such Products shall be deemed to have been accepted by Buyer and to conform to these Terms and to the applicable product specifications ("Product Specifications"). Product Specifications are available on GLIPM's website or may be obtained by calling Customer Service at (800) 235-0285.
  5. Allocation of Product: If GLIPM is unable for any reason to supply the total demands for the Product specified in Buyer's order, GLIPM may allocate its available supply among any or all buyers on such basis as GLIPM deems fair and practical, without liability for the shortfall in delivery. Buyer shall be obligated to pay the purchase price of the Products delivered to Buyer, even if the order is incomplete.
  6. Time of Payment; Late Fee and Collection Costs: All prices are subject to change from time to time without notice; if shipments will be billed at the price quoted in the Order Confirmation. Provided Buyer's credit has been approved by GLIPM, terms of the Sale are net 30 days, unless otherwise stated in writing by GLIPM. GLIPM reserves the right to require full or partial payment in advance before proceeding with fulfillment of the Sale. If Buyer fails to make any payment when due, GLIPM, at its option and without limiting its right to exercise other lawful remedies, may defer or cancel further deliveries. In addition, GLIPM reserves the right to charge a late fee equal to 10 percent (10%) per annum from the date payment is due until paid; and Buyer shall be liable for any collection costs that GLIPM incurs, including reasonable attorneys' fees.
  7. Other Charges: Additional charges may be levied for services provided and costs incurred by GLIPM, including, without limitation, handling, labeling, restocking, repacking/repackaging, filling orders below minimum quantity, etc. Such charges shall be included in the Order Confirmation if known on the date of the Order Confirmation.
  8. Taxes and other Fees: Any use tax, sales tax, excise tax, duty, custom, inspection or testing fee, or any other tax, fee or charge of any nature whatsoever imposed by any governmental authority on or in connection with the Sale shall be paid by Buyer and, if disbursed by GLIPM, shall be reimbursed by Buyer. If Buyer is exempt from any such tax, fee or charge, Buyer shall provide proof of exemption with its order.
  9. Returns: Buyer may not return Products unless timely notice is given as provided in Section 4 and the return is authorized by GLIPM in writing. GLIPM will not accept broken containers, or Products deteriorated due to improper storage, the effects of heat, cold or moisture, or other conditions. Products may not be returned for credit except with GLIPM's permission, and then only in strict compliance with GLIPM's return-shipment instructions. Credit will only be issued once Products have been received. A restocking charge may be levied.
  10. Technical Assistance: At Buyer's request, GLIPM may furnish technical assistance and information with respect to GLIPM's Products. Unless otherwise agreed, such assistance and information will be provided without charge. GLIPM makes no warranties of any kind or nature with respect to technical assistance or information provided by it. Any suggestion by GLIPM regarding use, application or suitability of the Products shall not be construed as an express or implied warranty unless expressly designated as such in writing by GLIPM.
  11.  Buyer's Responsibilities in Connection with Use and Sale of Products: a. Testing. Buyer acknowledges that the Products may not have been tested by GLIPM for safety and efficacy for food, drug, device, cosmetic, commercial or any other use, unless otherwise stated in writing by GLIPM. Buyer expressly represents and warrants to GLIPM that Buyer will properly test, use, manufacture and market all Products purchased from GLIPM that are used or sold by Buyer, including Products that are incorporated into Buyer's products, in accordance with the practices of a reasonable person who is an expert in Buyer's industry and in strict compliance with all applicable federal and state food, drug, device and cosmetic and other relevant laws and regulations, now and hereafter enacted. b. Compliance with Certain Laws. Buyer further warrants to GLIPM that any products manufactured using GLIPM's Products shall not be adulterated or misbranded within the meaning of the Federal Food, Drug and Cosmetic Act and shall not be products which may not be introduced into interstate commerce under Sections 404, 505, or 512 of such Act. Items that are not registered under the Toxic Substance Control Act (TSCA) or Federal Insecticide, Fungicide and Rodenticide Act (FIFRA) are for use only in Research & Development by technically qualified individuals, or in products not regulated by TSCA or FIFRA (such as cosmetics, foods, food additives, etc.). Buyer assumes responsibility to assure that the Products purchased from GLIPM are approved for use under TSCA or FIFRA, if applicable. c. Hazards. Buyer has the responsibility to verify the hazards and to conduct any further research necessary to learn the hazards involved in using Products purchased from GLIPM. Buyer also has the duty to warn Buyer's customers and any auxiliary personnel (such as freight handlers, etc.) of any risks involved in using or handling the Products. Buyer agrees to comply with instructions, if any, furnished by GLIPM relating to the use of the Products and not to misuse the Products in any manner. GLIPM assumes no responsibility for ascertaining or monitoring how its Products are used by Buyer or anyone acquiring the Products from Buyer, or whether any such use complies with applicable U.S. or foreign laws and regulations. d. Purchasers outside of USA. In the case of Buyers located outside of the United States, GLIPM makes no representation or warranty that the Products or the intended uses of the Products comply with applicable laws or regulations in the Buyer's jurisdiction including, without limitation, safety, efficacy and environmental laws and regulations. e. Repackaging, Relabeling, Inclusion in Other Products. If the Products purchased from GLIPM are to be repackaged, relabeled or used as starting materials or components of other products, (a) Buyer will verify the suitability of the Products for their intended use or purposes; (b) Buyer assumes the risk of any loss, damage, or liability that may arise as a result of such repackaging, including without limitation contamination or spoilage; and (c) Buyer shall not use GLIPM's name, or any GLIPM trademarks, sales materials, or other identifying information on or in connection with the sale of any repackaged or relabeled Products or Products that are components of Buyer's products. f. Duty to Give Notice of Incidents. Buyer shall notify GLIPM immediately upon Buyer's becoming aware of any accident or other incident involving GLIPM's Products resulting in personal injury or damage to property, and Buyer shall fully cooperate with GLIPM in the investigation and determination of the cause of such incident and shall make available to GLIPM all statements, reports, and tests made by Buyer or made available to Buyer by others. The acceptance of such information by GLIPM and any investigation by GLIPM shall not constitute an assumption of any liability by GLIPM. g. No Liability to Buyer's Customers. In any case in which Buyer resells the Products to any third party, Buyer shall warn its customer of the stipulations and obligations stated herein with respect to the Products, and Buyer shall bear the risk of any noncompliance by Buyer's customer. h. Not for Use in Tobacco Products. GLIPM's Products are not for use in tobacco products, e cigarettes, or any other nicotine delivery devices, applications and/or products. Buyer will be liable to GLIPM for any violation of the foregoing prohibition by Buyer or any subsequent purchaser of the GLIPM Products originally sold to Buyer (including GLIPM Products incorporated into other products).
  12. Non-Disclosure: Each Party agrees that it shall not use or disclose confidential or proprietary information disclosed to it by the other Party, including, without limitation, the Terms of the Sale to the Buyer and the nature and results of any testing by either Party. Buyer further agrees that it will not reverse engineer any substances that are provided to it by GLIPM, including the Products.
  13. No Rights in Third Parties: These Terms are not intended to, nor shall they be construed to, create any rights in or to benefit any third parties, including, without limitation, any person or entity purchasing products from Buyer that incorporate the Products.
